Serbian mark of conformity
The Law on Technical Requirements for Products and Conformity Assessment ("Official Gazette of RS", No. 36/09) stipulates that the manufacturer places a mark of conformity on a product that is harmonized with a technical regulation, if it is prescribed by a technical regulation.
The appearance of the Serbian mark of conformity is regulated by Art. 30 to 33 of the Regulation on Manner of Conformity Assessment, Content of Document of Conformity, and Shape, Appearance and Content of Mark of Conformity ("Official Gazette of the Republic of Serbia" No. 98/09 and 23/17). The regulation (Article 31) stipulates, inter alia, that the Serbian mark of conformity is the only mark that confirms that the product, put on the market or in use in the Republic of Serbia, is in compliance with the requirements of the Serbian technical regulation(s), if that regulation stipulates its placement on the product.

This provision shall cease to apply on the date of the entry into force of the ratified International agreement on the assessment of conformity and acceptance of industrial products with the European Union (ACAA agreement) in the part of the products to which that agreement applies, and in the part of the products to which this agreement does not apply the provision of Article Article 31 of this Regulation shall cease to apply on the date of accession of the Republic of Serbia to the European Union.
Exceptionally to this provision, the CE mark shall be valid in the Republic of Serbia prior to the signing of the ACAA Agreement if the recognition of the document of conformity and the associated mark of conformity has been preformed in accordance with the provisions of Articles 28 to 30 of the Law on Technical Requirements for Products and Conformity Assessment.
From the date of signing the ACAA Agreement, and at the latest, from the date of accession to the EU, the CE mark will be applied only Article 37 in relation with the Article 32 of the Regulation, the content and form prescribed by that Regulation (in accordance with Regulation 765/2008 / EC).
The manner and use of the mark of conformity is prescribed by the Rulebook of manner of affixing marks of conformity on products, and use of the mark of conformity ("Official Gazette of RS", No. 25/10).
For a product that is not in compliance with the prescribed requirements, or for a product for which the marking of conformity is not prescribed, it is forbidden to place the mark of conformity.
The Serbian mark of conformity is the only indication confirming that the product placed on the market or in use in the Republic of Serbia is in compliance with the requirements of the Serbian technical regulation, if this regulation foresees its placement.
The Serbian mark of conformity shall be placed by the manufacturer, or his representative or importer, if it is stipulated by the technical regulation, after complying with the conformity assessment. He does this independently or according to the instructions given by the designated body that performed the conformity assessment. In particular, it should be emphasized that the mark of conformity is not purchased, ordered or received from the designated conformity assessment body. The person who affixes the mark of conformity is doing it by himself according to the prescribed dimensions, or someone else does it for him. The Serbian mark of conformity in the original format can be downloaded from the website of the Ministry of Economy: www.privreda.gov.rs or www.tehnis.privreda.gov.rs.
The manner and places for affixing the Serbian mark of conformity are prescribed by the
Rulebook of manner of affixing marks of conformity on products, and use of the mark of conformity ("Official Gazette of RS", No. 25/10).
The Serbian mark of conformity shall be placed:
1) on the product;
2) on the plate accompanying the product;
3) on products packaging or the label, or pendants placed on its packaging;
4) in the documentation accompanying the product.
1) It is prescribed that the Serbian mark of conformity shall be placed on the product, in a place that is accessible for the inspection. This mark must be placed on a product in a place that is readily. Marks of conformity, affixed on the product must be kept in case of its further processing, or finishing of products (or parts of products), or when the product is installed in facilities or plants. If the mark of conformity during processing or the product finishing (or parts of the product) has to be removed, this mark must be transferred to another place on the product. 2) Exceptionally, if it is not possible to affix the Serbian mark of conformity on the product because of its nature, dimensions or some other features that prevent it, this mark can be placed on the plate which is placed on the product, on the sticker or on the pendant accompanying the product.
There are three possible ways to affix a Serbian mark on a product or on a plate accompanying the product:
1. By imprinting it on a product, if it is possible to imprint and permanently save the mark, without causing damage to the product;
2. By imprinting it on the plate (if the imprinting on the product is not possible, due to possible damage, product dimensions, etc.) placed on the product and which is intended for this purpose;
3. By printing a product with non-erasable color, if the product can not be marked by imprinting of the mark of conformity.
Exceptionally, if it is not possible to affix a mark of conformity on the product by imprinting or printing, or if it is not possible to do so on the product plate, the Serbian mark of conformity shall be placed on its packaging and, if that is not possible, on the label or sticker placed on the product packaging and stated in the documentation accompanying the product.
If the Serbian mark of Conformity can not be placed in any of the listed places, this mark shall be affixed by printing on a documentation that accompanies the product (user manual, warranty card or other documentation).
In particular, it is necessary to emphasize that for imported products, in order to preserve their originality, from the point of view of the customers requirements and rights, it is not possible to comply with the indicated order of putting the Serbian mark of conformity. On the other hand, it would be pretentious to require foreign manufacturers to place the Serbian mark of conformity on the products they place on the Serbian market.
In view of this, the importer of foreign products shall place the Serbian mark of conformity in the prescribed order according to point 3) onwards.
