IMPORTANT: The application of new technical regulations

NOTICE REGARDING APPLICATION OF EXCLUSIVE USE OF NEW TECHNICAL REGULATIONS

 Having in mind that exclusive application of new technical regulations started on January 1st 2012, i.e. Rulebook on Electrical Equipment Designed for Use within Certain Voltage Limits ("Official Gazette of RS", No. 13/10), Rulebook on Electromagnetic Compatibility ("Official Gazette of RS", No. 13/10) and Rulebook on  Safety of  Machinery ("Official Gazette of RS", No. 13/10) which came into force on March 20th 2010 and, that a transitional period during which there was a possibility of conducting product certification in accordance with the ordinances and regulations on mandatory attestation is over, we inform you that: 

1.  For the purposes of customs clearance of imported products covered by the new technical regulations governed by Ministry of Finance and Economy (MFE) and Annex 5A of the Decision on determining goods subject to issuance of specific documents on importation, exportation and transit (Decision) exclusively documents of conformity and/or other documents issued in accordance with the new technical regulations can be used, as follows:

- CONFIRMATION OF CONFORMITY or EXTRACT from the records on the issued confirmation of conformity (issued by the relevant designated conformity assessment body)

- DECISION ON RECOGNITION OF VALIDITY OF FOREIGN DOCUMENT OF CONFORMITY or EXTRACT FROM THE REGISTER ON VALIDITY OF FOREIGN DOCUMENT OF CONFORMITY (issued by the Ministry of Finance and Economy).

2.  Opinions on necessity for mandatory certification issued by MoERD till 31st December 2011 are still valid in the part relating to the application of new technical regulations, and is not valid for the part relating to certification of products according to the old ordinances and regulations on the mandatory certification.

3.  MFE will continue to issue opinions on necessity to obtain document of conformity, and in appropriate exceptional circumstances opinions may be such that certain products are not required to have documents of conformity or that the documents can be obtained after the customs clearance of imported products covered by technical regulations governed by MoERD and Annex 5A of the Deciosion.

4.  Certificates (attests) for products, that are already placed on the market of the Republic of Serbia before January 1st 2012 in accordance with the old ordinances and regulations on the mandatory certification, that accompany the product are valid until date issued on the certificate (not valid for purposes of customs clearance referred to in point 1).

For each product that is manufactured or imported from January 2nd 2012, that is, any new import or placing products on the market from that date (regardless of the fact that certificate/attest has previously been issued for that type, product type or model) it is mandatory to obtain certificates of conformity issued from the designated conformity assessment bodies.
