ATEX: important notice

Information on validity of certificates of conformity issued in accordance with the Order on mandatory certification of electrical equipment for explosive atmospheres

We inform all interested parties: manufacturers, importers, distributors, users, designated conformity assessment bodies, as well as  market surveillance authorities, that, according with Article 19 of the Rulebook on equipment and protective systems intended for use in potentially explosive atmospheres  (“Official Gazette of the RS”, No 1/2013 - hereinafter referred to as the Rulebook)  all certificates of conformity, “type” and “individual”are valid until expire of the period for which they are issued, in accordance with the Order on mandatory certification of electrical equipment for potentially explosive atmospheres ("Official Gazette of the FRY, 35/95 - hereinafter: the Order) which has ceased to be applied on January 1, 2015.

Having in mind the above, in terms of putting products intended for use in potentially explosive atmospheres on the market and / or use in the Republic of Serbia from January 1, 2015, we indicate the following:

1. Electrical devices and components of electrical and non-electrical equipment for potentially explosive atmospheres, manufactured in the Republic of Serbia or imported into the Republic of Serbia, for  which  were  issued “individual” certificates of conformity by January 1, 2015, in accordance with the Order (certificates with unlimited validity period that approve the conformity of individual pieces of electrical devices/assemblies) CAN BE PUT ON THE MARKET AND/OR USE OR DELIVERED  TO THE MARKET IN THE REPUBLIC OF SERBIA AFTER JANUARY 1, 2015, IN ACCORDANCE WITH THE RULEBOOK , NAMELY WITHOUT REPEATED CONFORMITY ASSESSMENT PROCEDURE.

2. “Type” certificates on conformity (certificates that approve the conformity of types of electrical devices / assemblies) which were issued in accordance with the Rulebook  until January 1, 2015, although valid until the expire of the period for which are issued, in accordance with Rulebook do not represents the basis for placing individual pieces of electrical devices / assemblies intended for explosive atmospheres on the market and/or use or supply in the market in the Republic of Serbia from January 1, 2015. These certificates, up to the day of expiry of the period for which they were issued, may be used for obtaining individual certificates on conformity set out in the Annex 9 of the Rulebook,  or used for their efficient conversion into documents of conformity according to the appropriate conformity assessment procedures referred to in Article 10 of the Rulebook.  DURING IMPLEMENTATION  OF THE PRESCRIBED PROCEDURES OF CONFORMITY ASSESSMENT , ACCORDING TO THE RULEBOOK, THE DESIGNATED CONFORMITY ASSESSMENT BODY IS OBLIGED TO TAKE INTO ACCOUNT CURRENT "TYPE” OF CERTIFICATE ON CONFORMITY ISSUED IN ACCORDANCE WITH THE ORDER AND PERFORM ONLY THOSE ACTIVITIES OF CONFORMITY ASSESSMENT NECESSARY FOR ADDITIONAL COMPLIANCE WITH THE CONDITIONS  OF THE RULEBOOK.
