Notice on the beginning of the implementation of the Rulebook on the noise emission in the environment by equipment for use outdoors
The implementation of the Rulebook on the noise emission in the environment by equipment for use outdoors ("RS Official Gazette", No. 1/13) started
We inform all interested parties, i.e. product suppliers (manufacturers and their representatives, importers and distributors), conformity assessment bodies (CABs), potential users and consumers, as well as the authorities of inspection and market surveillance that the Rulebook on the noise emission in the environment by equipment for use outdoors ("RS Official Gazette", No. 1/13 - hereinafter: the Rulebook) begins to implement by 1 July 2015.
From 1 July 2015 all the equipment referred to Art. 9 and 10 of this Rulebook, which is intended for outdoor use and which is placed on the market from that date and/or put into service in the Republic of Serbia, have to fill the requirements in terms of limits and/or labeling noise, the implementation of conformity assessment procedures, making or providing certificates of conformity, marking of conformity, in accordance with the Rulebook.
The Rulebook complies with all the requirements and principles of the EU Directive 2000/14/EC, including its amendments to the Directive 2005/88/EC. Importers of equipment to which the Regulation applies, may place on the market and/or put into use that equipment only if it conform with the requirements of the Directive, by providing EC declaration of conformity of equipment with this directive, translated into Serbian, as well as translation of the instructions for use. Exceptionally, for equipment that is not formally conform with this Directive, importers who are authorized by a foreign manufacturer (authorized representative), before placing of such equipment on the market and/or put into service in the Republic of Serbia, must fulfill obligations for representative, in accordance with the authority given by manufacturer and requirements of this Rulebook (performing selected conformity assessment procedure, making the declaration of conformity, marking).
Having in mind that the Ministry of Economy has not yet designated any body for the implementation of conformity assessment procedures referred to Article 11 of the Rulebook, we inform the domestic manufacturers of equipment referred to Article 9 of the Rulebook that for the conformity assessment of the equipment, until the desination of CABs they may contact the following CABs which are accredited for testing of noise emissions in accordance with standard SRPS EN ISO 3744: 2008 Acoustics - Determination of sound power levels of noise sources using sound pressure - Engineering method in an nearly free field over a reflecting plane:
- „Instalacija inženjering” doo , Belgrade
- The Institut for material testing IMS ad, Belgrade
- The Institute for safety and preventive engineering doo, Novi Sad
- University of Niš, Faculty of Labur Safety in Niš, Center for technical examination, Niš.
Manufacturers are obliged to ensure that the noise emission tests conducted in accordance with test codes in Annex 3 B of the Rulebook, given that, in accordance with technical regulations within the jurisdiction of the Ministry of Economy, manufacturers are solely responsible for the conformity of equipment with the prescribed technical requirements.
All mentioned accredited CABs informed the Ministry of Economy that they plan to apply for designation in accordance with the Rulebook within 3 months from the starting date of its application, in accordance with Article 17 of the Regulation on the Manner of Designation and Authorisation of Conformity Assessment Bodies ("RS Official Gazette", No. 98/09). Keeping this fact in mind, accredited CABs can issue to domestic producers or, where applicable, representatives of foreign manufacturers, certificates of conformity in accordance with Annex 6, 7 or 8 of the Rulebook. Until the designation of CABs, documents issued by accredited CABs do not indicate, in any way, that they issued confomity documents as Designated bodies, in accordance with the Rulebook.
