Aerosol dispensers
Adoption of a technical regulation with the aim of aligning the national legislation with COUNCIL DIRECTIVE of 20 May 1975 on the approximation of the laws of the Member States relating to aerosol dispensers (75/324/EEC) is within jurisdiction of the Ministry of Economy.
In accordance with the National programme for the adoption of the acquis, and pursuant to Article 6 Paragraph 1 of the Law on technical requirements for products and conformity assessment ("Official Gazette of the RS", No. 36/09), the minister of economy adopted the Rulebook on aerosol dispensers which was published in the "Official Gazette of the RS", No. 106/17 of 24 November 2017. This rulebook entered into force on 2 December 2017, and it shall start to apply on 1 January 2018.
For the purpose of this rulebook, the term ‘aerosol dispenser’ shall mean any non-reusable container made of metal, glass or plastic and containing a gas compressed, liquefied or dissolved under pressure, with or without a liquid, paste or powder, and fitted with a release device allowing the contents to be ejected as solid or liquid particles in suspension in a gas, as a foam, paste or powder or in a liquid state.
This rulebook prescribes requirements for design, construction, testing and labelling of aerosol dispensers, that have to be met for marketing of aerosol dispensers, and the safeguard clause.
Symbol „3” (inverted epsilon) affixed to aerosol dispenser shall mean that the aerosol dispenser fulfils the requirements of this rulebook.
Other than the inverted epsilon symbol, the person responsible for marketing of aerosol dispenser (manufacturer, importer) shall ensure that an aerosol dispenser bears the data referred to in Article 6 of this rulebook. The prescribed data shall be on the aerosol dispenser, and shall be in visible, legible and indelible characters in Serbian language or, where the data cannot be put on the aerosol dispenser due to its small dimensions (maximum capacity of 150 ml or less) a label may be attached to the aerosol dispenser.
Other than the law governing technical requirements for products and conformity assessment and this rulebook, the field of aerosol dispensers is also regulated by:
1) the law governing metrology and the specific bylaw on prepacked products;
2) the law governing transport of dangerous goods (The European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR));
3) the law governing chemicals and specific bylaw onclassification, labelling and packaging of chemicals.
